Please read these Terms and Conditions ("Terms") carefully before using DM Monkey (the "Service", "Platform", or "Software"), operated by Growthnix LLC ("Company", "we", "our", or "us").

By accessing or using DM Monkey, you agree to be bound by these Terms. If you do not agree to all of these Terms, you may not access or use the Service.

1. Eligibility

You must be at least 18 years of age and capable of forming a legally binding contract to use DM Monkey. By using the Service, you represent and warrant that you meet these requirements.

2. Use of the Service

DM Monkey is an automation platform designed to assist users with managing and automating Instagram direct message outreach.

You agree to use the Service only for lawful purposes and in accordance with these Terms. You agree not to:

Violate any applicable laws, regulations, or third-party rights
Use the Service to spam, harass, deceive, or send unauthorized or unsolicited messages
Circumvent platform safeguards, usage limits, or security features
Interfere with or disrupt the integrity, performance, or availability of DM Monkey

You acknowledge that automation tools carry inherent risk when used on third-party platforms.

3. User Responsibilities

You are solely responsible for:

Ensuring your use of DM Monkey complies with Instagram’s terms, rules, and policies
All messages, content, and actions executed through your account
Any consequences resulting from the use of automation, including account restrictions or bans
Maintaining the security of your login credentials, sessions, and connected accounts

DM Monkey does not control or guarantee outcomes related to third-party platforms.

4. Accounts and Access

Certain features of DM Monkey require account registration. You agree to provide accurate, current, and complete information and to keep your account information updated.

You are responsible for all activity that occurs under your account. Sharing accounts, reselling access, or bypassing plan limits is prohibited.

5. Intellectual Property

All content, software, source code, features, branding, logos, and functionality of DM Monkey are the exclusive property of Growthnix LLC and are protected by intellectual property laws.

You may not copy, modify, distribute, reverse engineer, or create derivative works from any part of the Service without prior written consent.

6. Suspension and Termination

We reserve the right to suspend or terminate your access to DM Monkey at any time, with or without notice, for any reason, including but not limited to:

Violation of these Terms
Misuse of the Service
Behavior that exposes the Company to legal, operational, or reputational risk

Upon termination, all rights granted to you under these Terms will immediately cease.

7. Disclaimer of Warranties

DM Monkey is provided on an “AS IS” and “AS AVAILABLE” basis.

We make no warranties, express or implied, including but not limited to merchantability, fitness for a particular purpose, or uninterrupted availability. We do not guarantee message delivery, account safety, or performance results.

Your use of the Service is at your own risk.

8. Limitation of Liability

To the fullest extent permitted by law, Growthnix LLC, its owners, employees, contractors, affiliates, and partners shall not be liable for any direct, indirect, incidental, consequential, special, or exemplary damages, including but not limited to:

Loss of profits, revenue, or goodwill
Business interruption or reputational harm
Instagram account suspension, restriction, or banning
Data loss, unauthorized access, or service downtime
Any damages arising from your use or inability to use DM Monkey

You assume full responsibility for all risks associated with using the Service.

9. Indemnification

You agree to indemnify and hold harmless Growthnix LLC from any claims, damages, liabilities, losses, and expenses (including reasonable attorneys’ fees) arising from:

Your use or misuse of DM Monkey
Your violation of these Terms
Your violation of Instagram’s terms or any third-party rights

10. Modifications to the Terms

We reserve the right to update or modify these Terms at any time. Material changes will be communicated via the Platform or email.

Continued use of DM Monkey after changes take effect constitutes acceptance of the revised Terms.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law principles.
